The offer and sale of products on our website ("www.tagliapasta.com") are regulated under these General Terms and Conditions of Sale. Products on www.tagliapasta.com are sold directly by Food Valley s.r.l., with headquarters in Italy, Via Podgora, 85 - 40062 Molinella (BO), Registered in the Italian Companies Registry, VAT code n. 03615121203.

1. Our Commercial Policy

1.1 The General Terms and Conditions of Sale only regulate the offer, the making and the acceptance of purchase orders of products on www.tagliapasta.com between the users on www.tagliapasta.com and the Seller.
1.2  The General Terms and Conditions of Sale don't regulate services or the sale of products provided by entities that are different from the Seller on www.tagliapasta.com through links, banners or other hyperlinks. Before purchasing products from entities that are different from the Seller, we suggest you to check their terms and conditions of sale. The Seller is not responsible for services provided by third parties or for any other online commercial activity between the users of www.tagliapasta.com and third parties.

2. Making an Agreement with Food Valley

2.1 In order to purchase one or more products on www.tagliapasta.com, you will have to create your order online and send it to the Seller by e-mail, following the related instructions.
2.2 The order includes the General Terms and Conditions of Sale, a summary of the essential information about each ordered product and the related price, the methods of payment you will be able to use to purchase each product and the method of delivery, shipping and delivery costs, conditions and time for returning products.
2.3 The agreement starts as soon as the Seller receives by e-mail your order, after verifying that your data are correct.
2.4 Before proceeding to purchasing the products and making your order, please read carefully the General Terms and Conditions of Sale, print one copy by clicking the print command and save one copy for your personal use.
2.5 The order will be archived in our database for the period required to process the order and always within the terms required by law.
2.6 Before making the order, you will be asked to check and correct any possible mistake in your data.
2.7 The language used for making the agreement with the Seller is Italian.
2.8 Once the agreement is made, Food Valley will process your order.
2.9 The Seller won't be able to process your orders if you fail to proceed to payment or if they are incomplete or incorrect and products are not available. In these cases, we will inform you by e-mail that the agreement was not completed and that the Seller couldn't process your order, specifying the reasons. If products on www.tagliapasta.com are not available anymore after you visited the website and made your order, the Seller will inform you immediately and always within thirty (30) days from the day that follows the day of your order. If you already paid your order, the Seller will provide you with a refund of the amount you paid.
2.10 By making your order, you are confirming that you accept and commit to comply with the Seller's General Terms and Conditions of Sale. If you don't agree with one or more of the terms included in the General Terms and Conditions of Sale, please do not order products on www.tagliapasta.com.

2.12 Once the agreement is made, the Seller will send you an e-mail confirming your order, including a summary of the information already included with the order (General Terms and Conditions of Sale, Return Policy, essential information about products and prices, methods of payment and delivery costs).

3. Warranty and Prices

3.1 Products are described on www.tagliapasta.com in the related product description box. However, pictures and colors of the products you can purchase on www.tagliapasta.com may not correspond to the actual ones, depending on the Internet browser or the screen you are using. That's why they can only be considered as representative of reality.
3.2 Prices are shown in Euros and include VAT. Prices may vary and be updated. Please double check the final price before making your order.
3.3 All the products are packed in the best way possible to protect them during transport.
3.4 If you decide to return your order, the Seller has the right to reject the return if products don't have their own package or are visibly used or were changed or damaged.

4. Payment

4.1 Please choose one of the methods of payment to pay your order and the related shipping/delivery charges when making your order.
4.2 If you pay by credit card, your financial information (i.e. the number of your credit/debit card or its expiry date) will be sent to Paypal or to other banks providing remote payment services through a cryptographic protocol. Third parties won't be able to access this information. The Seller will use this information only to complete the essential procedures related to your purchase or for making a refund in case of return or in case it is necessary to provide info to authorities concerning frauds on www.tagliapasta.com. The amount of your purchase and shipping/delivery charges, as indicated on your order, will be charged to your bank account as soon as your order is shipped.
4.3 If you pay with PayPal, your financial information will be managed by Paypal servers safely and securely. In any case, financial data will never be managed by our website or stored on a database. The payment will be managed by PayPal through SSL security protocols.

5. Shipping and Delivery

5.1 Shipping charges, if not otherwise specified, are not included and will be borne by the Customer. Prices don't include custom duties or export taxes.
5.2 All the products are packed in order to protect them during transport. In case your package is visibly damaged, please accept it with reservation and inform the courier about the issue. If the product is damaged, please contact us before the 7th day after delivery and send us an inquiry.
5.3 All the products will be shipped with national and international couriers as soon as possible.
5.4 We are not responsible for delivery times that depend on the courier, but we will do our best to solve any possible issue that may arise.

7. Return Policy and Refund Time

7.1 If you are not satisfied for any reason with your purchase, return your item(s) within fourteen (14) days of receipt of order for full refund of your purchase.
7.2 Product(s) that are not eligible for return include the following:
- Customized products.
- Sealed products that are not eligible for return for hygiene reasons and that have been opened on receipt.
7.3 You can return items only if they are in the same conditions as when they were delivered to you. Please also note that you are responsible for the content of the package you are returning.

Read carefully this section as it is an integral part of these General Terms and Conditions of Sale. When you make an order, you are confirming that you are accepting these conditions.

9. Applicable Law and Controversies

9.1 The General Terms and Conditions of Sale are regulated under the Italian law and in particular under the Italian legislative decree of September 6, 2005 n. 206 of the Codice del Consumo (Consumer Code), with reference to the rules regulating distance contracts and under the Italian legislative decree of April 9, 2003 n.70 concerning e-commerce.
9.2 The General Terms and Conditions of Use are regulated under the Italian Law.
9.3 Any controversy that may arise from this agreement will be managed by the Camera di Commercio of Bologna under its Rules of Conciliation.
9.4 If the Parties are willing to bringing a proceeding before court, the competent court of jurisdiction is in the Consumer's area of domicile or residence. This is mandatory under Art. 33, Par, 2, lett. u of the Italian Legislative Decree 206/2005.

10. Editing and Updates

10.1 The General Terms and Conditions of Sale are edited depending on law changes. The new General Terms and Conditions of Sale will be effective from the day of publishing specified on www.tagliapasta.com.

11. Final Clause

11.1 This agreement repeals and replaces any written or oral agreement or negotiation that the Parties may have made previously concerning the subject of this agreement.
